Justice is believed to have been served if the guilty person is fit to receive his/her judgment. In this case if the person is really sick and in need of treatment abroad he should be allowed to go and come back to finish his legal process. There is no reason good enough to deny him especially when we all know some before him with similar if not worst case were allowed to be treated abroad or by doctors from abroad!
